By accessing evarisdigital.com, submitting a form, booking an appointment, or engaging Evaris Digital LLC for services, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the website or our services.

Evaris Digital LLC provides digital growth services for local businesses, including:

• Website design, development and maintenance
• Google Business Profile setup and management
• Local SEO and organic visibility work
• Paid advertising, including Google Ads campaign management
• Reputation and review management
• AI-driven follow-up, automation and CRM implementation
• Digital marketing strategy and consulting

The exact scope, deliverables, timeline and fees for any engagement are defined in a separate proposal, agreement or written scope of work between you and Evaris Digital LLC.

You agree to:

• Provide accurate, current and complete information when submitting forms or booking appointments
• Provide timely access, approvals, content and account access needed for us to perform services
• Confirm you have the right to use any content, logos, images or materials you provide to us
• Use evarisdigital.com lawfully and refrain from attempting to disrupt, scrape, reverse engineer or gain unauthorized access to the site

All content on evarisdigital.com — including text, graphics, layout, code, branding and the Evaris Digital name and logo — is owned by Evaris Digital LLC and protected by applicable intellectual property laws. You may not copy, reproduce, republish or redistribute it without written permission.

Content you supply to us remains yours. Ownership of deliverables produced during an engagement is governed by your written agreement with Evaris Digital LLC; unless stated otherwise, our internal processes, templates, tooling and systems remain our property.

Our services rely on third-party platforms such as Google, Meta, hosting providers, CRM and messaging providers, and payment processors. Those platforms are controlled by their own terms, policies, pricing and availability. Evaris Digital LLC is not responsible for changes, outages, account actions, algorithm updates or decisions made by third-party platforms.

We aim to keep evarisdigital.com available and accurate, but the site is provided on an as-available basis. We may modify, suspend or discontinue any part of the website at any time without notice, including for maintenance or updates.

The website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Marketing results depend on many factors outside our control, and Evaris Digital LLC does not guarantee specific rankings, lead volume, revenue or other outcomes.

To the maximum extent permitted by law, Evaris Digital LLC and its owners, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost data or business interruption, arising from your use of evarisdigital.com or our services. Our total aggregate liability for any claim will not exceed the amount you paid to Evaris Digital LLC for the services giving rise to the claim in the three months preceding the claim.

Where applicable, fees, billing frequency and payment methods are set out in your proposal, invoice or service agreement. Unless otherwise agreed in writing: invoices are due upon receipt, recurring services are billed monthly in advance, and third-party costs such as ad spend, domains, hosting and software subscriptions are your responsibility. Late or failed payments may result in pausing or suspending services. Fees already paid for work performed are non-refundable unless stated otherwise in your agreement.

If you voluntarily opt in to text messages from Evaris Digital LLC, you may receive messages such as:

• Appointment confirmations
• Appointment reminders
• Scheduling and rescheduling notifications
• Service-related messages
• Marketing and promotional communications, if you separately opt in to marketing SMS

Transactional (non-marketing) SMS consent and marketing SMS consent are handled separately. Opting in to appointment and service-related messages does not opt you in to marketing messages, and you may opt out of either at any time.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance. Consent to receive marketing text messages is not required as a condition of purchasing any goods or services.

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless service provider, network availability, and other factors outside the control of Evaris Digital LLC.

You must be at least 18 years old to participate in Evaris Digital LLC's SMS messaging program. By opting in to receive SMS messages from Evaris Digital LLC, you represent and confirm that you are at least 18 years of age.

Evaris Digital LLC may adjust, improve or discontinue features, tools, platforms or service offerings over time. If a change materially affects an active engagement, we will communicate it to you in advance where reasonably possible.

Either party may terminate an engagement in accordance with the notice terms of the applicable agreement. Evaris Digital LLC may suspend or terminate services immediately for non-payment, unlawful activity, or misuse of our website or services. Upon termination, you remain responsible for fees and third-party costs incurred through the termination date.

These Terms & Conditions are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Ohio.

Evaris Digital LLC may update these Terms & Conditions from time to time. Updates are posted on this page with a revised "Last updated" date, and continued use of evarisdigital.com or our services means you accept the revised terms.
